Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Multiple entries permitted but only one entry will be awarded for each online order placed during the promotional period, regardless of the number of items ordered.

If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the Internet account is held.

Promotion commences on 09/03/09. Entries close 11:59pm AEST on 13/04/09. Entries will be divided based on the day they are received. One (1) winner will be drawn for each day of the promotion. All draws will take place at the Promoter’s office, Level 8, 240 Sandgate Road, Albion QLD 4010 at 9am AEST on 15/04/09. A total of thirty-six (36) winners will be drawn, being one (1) winner for each day of the promotional period. Entries in each daily prize draw will NOT be entered into any subsequent daily prize draws. Winners will be notified by mail and winners’ names will be published in The Australian on 29/04/09.

There are thirty six (36) x prizes to be awarded in this promotion. One (1) x prize will be awarded for each day of the promotion, to the first valid entry drawn for that day. The first valid entry drawn from each daily prize draw will win a prize pack valued at $916.40. The prize pack consists of:

52 x 'pick only' large pizza vouchers; and
-
20 x DVD titles, as determined by the Promoter in its absolute discretion.
The vouchers are valid until 30/06/2010. Vouchers can only be used for standard 'pick up' orders at any Domino's outlet in Australia. The following surplus costs may be applicable (and are not covered by the voucher): $1.50 extra for puff pizzas, $2.50 extra for big taste pizzas, half 'n' half pizzas, cheese burst, the edge and each additional topping, $3.30 extra for double up edge and triple cheese. The voucher is not valid with any other coupon. A 10% surcharge applies on public holidays, which is not covered by the voucher. Any ancillary costs associated with redeeming the vouchers are not included. Any unused balance of the vouchers will not be awarded as cash. Redemption of the vouchers is subject to any terms and conditions of the issuer including those specified on the vouchers.

If the winner of a prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.

Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.

If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

A draw for any unclaimed prizes may take place on 15/07/09 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners’ names will be published in The Australian on 27/07/09.

Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

As a condition of accepting the prize, a winner may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
