Domino’s Pizza Enterprises Limited - Media Statement

On 26 February 2016, Domino's Pizza Enterprises Limited (DPE) made an application for an injunction in the NSW Supreme Court in relation to the proposed publication of a documentary created by Ms Phoebe Stuart-Carberry concerning DPE and Precision Tracking Pty Ltd.

The Company sought the injunction after Ms Stuart-Carberry made numerous threats to DPE about the content and publication of the documentary. In granting the injunction, the Court referred to her behaviour as arguably extortionate. DPE was also granted access to the documentary notwithstanding Ms Stuart Carberry's objections.

DPE reviewed the footage and chose not to pursue the injunction after the Company formed the view that there was nothing new within the untrue and misleading accusations being made by Precision Tracking and Ms Stuart-Carberry.

Group CEO and Managing Director Don Meij said the Company believed in freedom of speech, but with freedom of speech there also has to be integrity and responsibility.

“You can’t just make any claim and attack a company without those claims having substance. We need to protect our people and take a stance about unreasonable and antagonistic behaviour.”

The New South Wales Supreme Court ordered Ms Stuart-Carberry to pay DPE’s legal costs because of her refusal to comply with DPE’s reasonable request to provide a copy of the documentary prior to publication, meaning there would no need for court proceedings. A claim for these costs has been forwarded to Ms Stuart-Carberry.

Any money received by DPE from Ms Stuart-Carberry will be donated to charity.

“For us it isn’t about the money, it’s about the principle and sending a clear message that unreasonable and irresponsible behaviour will not be tolerated,” Mr Meij said.
